CYCLING FRIENDS Ltd. General Terms and Conditions
1. Advance payment
A valid booking requires an advance payment. In the case of non-payment, CYCLING FREINEDS Ltd. the booking is automatically cancelled.
2. Cancellation policy
In the event of booking cancellation, a cancellation fee will be charged as follows:
- Prepayment as agreed according to offer
- 45 days before the booked date 0%
- 30 day before the booked date 20%
- 10 day before the booked date 50%
- 1 day before the booked date 75%
No refunds are possible after the begin of the rental period of time, and the bike will be hold only for the first day of the rental.
3. Method of payment
Credit/debit card when booking/renting for the total period of the service. For security reasons, CYCLING FRIENDS Ltd. accepts only Visa, Mastercard and Verve.
4. Early return
No refund will be made in case the equipment is returned before the end of the contracted rental time.
5. Use of the rented equipment
The contractual partner cannot be younger that 18. The rental equipment can be given only for a personal use and only under the authorization of CYCLING FRIENDS Ltd. The equipment can be used for commercial and advertising purposes.
6. A rental or extension
Every kind of contract agreement can only be authorised by CYCLING FRIENDS Ltd. CYCLING FRIENDS Ltd. reserves the right to cancel the contract at any time in case of misuse of the equipment.
7. Return of the equipment
Return of the equipment has to be in according to the contract requirements in terms of place and time. The rental period ends on the last day determined in the contract. The client has to handover the equipment within the regular shop opening hours. In case of delivery service, the customer has to handover the equipment at the time and place agreed in the contract. In case of delay, CYCLING FRIENDS Ltd. will charge the fee for one further rental day.
8. Customer’s liability
The customer is responsible for being insured with adequate coverage against risks that may arise during the rental period. CYCLING FRIENDS Ltd. is not responsible for claims for accidents, drowning, death, injury, shock or damage to themselves and third parties, property, or for the loss of items caused by any reason. Also, the customer declares that his/her health condition enables him/her cycling and he/she has no illness that prevents him/her from cycling, and is aware that CYCLING FRIENDS Ltd. does not provide insurance to cover any bodily or property injury of the customer. CYCLING FRIENDS Ltd. is exonerated of any liability of that.
9. Customer’s responsibility
In event of loss, breakage or damage that may happen during the rental period of time, the amount of total loss will be charged 100% to the customer. The costs of the bikes, accessories and components will be shown by CYCLING FRIENDS Ltd. staff when required. The entire equipment is checked by CYCLING FRIENDS Ltd. after return. In the event of abnormal working of the bicycle and/or accessories at the begin of the rental period, the customer has to inform CYCLING FRIENDS Ltd. immediately. Otherwise breakage or damage will be charged to the customer. CYCLING FRIENDS Ltd. bears not responsibilities for any expenses arisen due to parking of the equipment in areas marked prohibited, such as fines or any other penalties.
10. Provider’s liability
CYCLING FRIENDS Ltd. claims to have taken all precautions to avoid mechanic failures of the rented equipment. However, in the event of mechanic failures CYCLING FRIENDS Ltd. does not bare any liability for damages that have been caused directly or indirectly to the customer, other people or properties. In the case of failures hindering the customer using the bike, the customer has to inform CYCLING FRIENDS Ltd. immediately. CYCLING FRIENDS Ltd. takes the responsibility to repair or replace the equipment fast. In case CYCLING FRIENDS Ltd. cannot provide service, the client is allowed to take the rented equipment and ask for repair.
11. Insurance
CYCLING FRIENDS Ltd. does not offer any type of insurance for theft or damage.
12. Derivatives amount authorisation
By signing this contract, you authorize NANO bicycles to charge in your credit/debit card account all the derivatives amounts from the rental of the equipment in case of these are caused by the customer.
13. The customer is obliged to respect the rules of South African traffic.
14. Contract languages is English.
15. The customer authorises CYCLING FRIENDS Ltd. to send you commercial information as advertisement by any media such as discounts, special promotions, new products in advance, etc. The customer can unsubscribe at any time under: info@cycling-friends.com
16. Personal information
The customer accepts the treatment of his/her personal information, as necessary for the agreed service, and for other products and services which he/she. The customer also allows CYCLING FRIENDS Ltd. to use of photos and images taken by CYCLING FRIENDS Ltd. staff for advertisement in the website and social media of the company and its partners. Customers personal information will be treated confidentially. CYCLING FRIENDS Ltd. will take the necessary measures to comply with European Regulations on the protection of personal data (GDPR). The customer has the right to access, rectify and, if required, to terminate the use of personal data by sending this in written to info@cycling-friends.com. The customers likewise authorises CYCLING FRIENDS Ltd. to transmit his/her data to other companies in the group or other companies with which the company may reach collaborations agreements, to improve the service given and for credit control whether in South Africa or abroad (including the USA), in any case complying with South Africa legislation regarding the protection of personal information. In the event of breaching this contract customer’s personal data may be revealed or handed over to third parties, as necessary to facilitate the collection of any outstanding debits.
