Terms & Conditions
1. Payment
A valid booking requires payment in the amount of 100%. In the event of non-payment within 10 working days of invoicing, the booking will be automatically cancelled by CYCLING FREINEDS Ltd.
2. Cancellation conditions
In the event of a booking cancellation, a cancellation fee will be charged as follows:
– 30 days prior to the booked date 50%.
No refund is possible after the 30th day before the rental period, the bike will only be held for the first day of the rental period.
3. Method of payment
Bank transfer/credit/debit card on booking/rental for the entire period of service. For security reasons CYCLING FRIENDS Ltd only accepts Visa, Mastercard and Verve.
4. Early return
No refund will be given for early return of equipment before the end of the contracted hire period.
5. Use of the rented equipment
The contractual partner may not be younger than 18 years of age. The rented equipment may only be used for personal use. Only with written permission from CYCLING FRIENDS Ltd can the bikes be used for commercial purposes, promotional purposes and sporting events (cycle races).
6. Rental or extension
Of any kind can only be authorised by CYCLING FRIENDS Ltd. CYCLING FRIENDS Ltd reserves the right to terminate the contract at any time for misuse of the equipment.
7. Return of the equipment
The return of the equipment shall be in accordance with the contractual provisions as to time and place. The rental period ends on the last day specified in the contract. The client shall hand over the equipment within regular shop opening hours. In the event of a delivery service by CYCLING FRIENDS Ltd, the customer shall deliver the equipment at the time and place agreed in the contract. In the event of delay, CYCLING FRIENDS Ltd will charge for an additional day’s hire.
8. Liability of the client
The client is responsible for ensuring that he/she is adequately insured against risks that may arise during the hire period. CYCLING FRIENDS Ltd shall not be liable for any claims arising from accident, drowning, death, injury, shock or damage to self or third party, property or for loss of property arising from any cause whatsoever. The client also declares that their state of health enables them to cycle and that they have no medical condition that prevents them from cycling, and that they are aware that CYCLING FRIENDS Ltd does not provide insurance to cover personal injury or damage to the client’s property. CYCLING FRIENDS Ltd. is exempt from any liability in this regard. This also applies to booked tours.
9. Responsibility of the client
In case of loss, breakage or damage during the rental period, 100% of the damage will be charged to the client. The cost of the bicycles, accessories and components will be accounted for by CYCLING FRIENDS Ltd. staff as required. All equipment will be checked by CYCLING FRIENDS Ltd. after return. If any malfunctions are found in the bicycle and/or accessories at the start of the hire period, the customer must inform CYCLING FRIENDS Ltd before use. Otherwise breakage or damage will be charged to the customer. CYCLING FRIENDS Ltd. shall not be liable for any costs incurred as a result of leaving the equipment in prohibited areas, such as fines or other penalties.
10. Liability of the Provider
CYCLING FRIENDS Ltd has taken all precautions to avoid mechanical breakdown of the hired equipment. However, CYCLING FRIENDS Ltd shall not be liable for any damage caused directly or indirectly to the client, other persons or property in the event of mechanical breakdowns. In the event of any malfunction preventing the customer from using the bicycle, the customer shall inform CYCLING FRIENDS Ltd immediately. CYCLING FRIENDS Ltd will be responsible for the prompt repair or replacement of the equipment provided that the fault lies with Cycling Friends Ltd. Should CYCLING FRIENDS Ltd be unable to provide the service before the end of the hire period, the hirer will be entitled to payment of the remaining hire charges.
11. Insurance
CYCLING FRIENDS Ltd does not provide insurance for theft or damage. The hirer is fully liable for any damage or theft.
12. Authorisation for Direct Debits
By signing this agreement you authorise Cycling Friends Ltd to debit your credit/debit card account for all amounts arising from the hire of the equipment, as well as costs incurred due to damage and loss of the hire items (bikes/accessories).
13. The customer is obliged to respect the South African traffic rules and laws.
14. The language of the contract is English.
15. The customer authorises CYCLING FRIENDS Ltd. to send you commercial information such as discounts, special promotions, new products in advance, etc. as advertising through any media. The customer can unsubscribe at any time at: info@cycling-friends.com
16. Personal Information
The customer agrees to the processing of his personal data to the extent necessary for the agreed service and for other products and services he uses. The customer also allows CYCLING FRIENDS Ltd to use photos and images taken by CYCLING FRIENDS Ltd staff for advertising on the company’s and its partners’ website and social media. Customers’ personal information will be kept confidential. CYCLING FRIENDS Ltd will take the necessary measures to comply with the European regulations on the protection of personal data (GDPR). The customer has the right to access, rectify and, if necessary, terminate the use of their personal data by sending this in writing to info@cycling-friends.com. The client also authorises CYCLING FRIENDS Ltd to share their data with other companies in the group or other companies with which the company may have co-operation agreements, for the purpose of improving the service provided and for credit control purposes in South Africa or abroad (including the USA), in all cases in compliance with South African legislation on the protection of personal data. In the event of a breach of this Agreement, the Client’s personal data may be disclosed or passed on to third parties where necessary to facilitate the collection of outstanding debts.
17. Any amendments to the contract must be in writing.
South African law shall apply. The place of jurisdiction is Cape Town.
